As a scientific discipline and profession, law has been for centuries at the heart of social and political power of many Western societies. Professors of law, as influential representatives of the profession, are important powerbrokers between academia, politics and the corporate world. Their influence is based on scientific reputation, institutional mandates inside and outside academia or privileged network connections with people in powerful positions. In this study, based on a full sample of all Swiss law professors in the years 1957, (...) 1980 and 2000, we contrast two theories of the distribution of power among law professors: Bourdieu’s thesis on the trade-off between scientific reputation and -academic institutional power vs. the thesis of an opposition between a group of established incumbents and socio-demographically marginal challengers who try to gain access to the profession. We show that among Swiss law professors the endowment with scientific capital is not opposed to the possession of institutional power within academia. Our findings reveal rather an opposition between a challenging group of professors devoid of resources and an incumbent fraction with a high amount of scientific, institutional and social capital alike. In the conclusion we discuss a series of explanations of this specific power structure, including the specific status scientific reputation and social capital can have for law professors. (shrink)

The past decade has been marked by a series of global crises, presenting an opportunity to reevaluate the relationship between science and politics. The biological sciences are instrumental in understanding natural phenomena and informing policy decisions. However, scholars argue that current scientific expertise often fails to account for entire populations and long-term impacts, hindering efforts to address issues such as biodiversity loss, global warming, and pandemics. This article explores the structural challenges of integrating an evolutionary perspective, historically opposed to functional (...) determinants of health and disease, into current biological science practices. Using data on Swiss biology professors from 1957, 1980, and 2000, we examine the structural power dynamics that have led to the division between these competing epistemologies, and how this division has influenced resource allocation and career trajectories. Our analysis suggests that this cleavage presents a significant obstacle to achieving fruitful reconciliations, and that increased academicization and internationalization may benefit functional biologists at the expense of evolutionary biologists. While evolutionary biologists have gained symbolic recognition in recent years, this has not translated into valuable expertise in the political domain. (shrink)

This study examined the laboratory dream content reported by 14 patients with schizophrenia and 15 controls, with a focus on reports obtained from NonREM sleep. Both the controls’ and patients’ frequency of dream recall following awakenings from NonREM and REM sleep were similar to values reported for healthy participants. Patients’ NonREM sleep narratives were shorter than those from controls. When compared to their reports from REM sleep, both groups’ NonREM sleep reports included significantly fewer words and reportable items. The controls (...) were more likely to report a subjective feeling of bizarreness for their REM sleep reports as compared to their NonREM sleep reports. This difference was not observed in patients with schizophrenia. Taken together, these findings suggest few differences between the NonREM sleep mentation of patients with schizophrenia and of controls and that sleep stage cognitive style is comparable in both groups, with NonREM sleep reports being more thought-like, less elaborate and bizarre than REM sleep reports. Les crises écologiques que ces dernières connaissent sont d’une ampleur telle qu’elles nous imposent non seulement de réformer notre manière de produire et de consommer, mais elles nous somment également de nous pencher sur nos équilibres subjectifs. Nous devons prendre (...) soin de nos expériences sensibles, en tentant de redéfinir notre manière d’être dans le monde et d’interagir avec nos environnements technologiques. L’enjeu est de taille à l’heure où la mise en scène par les médias des problèmes environnementaux contribue le plus souvent à désorienter l’opinion publique, en générant une angoisse qui s’avère le plus souvent préjudiciable à tout exercice d’évaluation des problèmes. One of the pressing purposes of the foundation of the Institut historique d'études thomistes was to provide a (...) properly historical approach to Aquinas's doctrine which would defend its integrity and authority, and refute the alarming assertations of those outside the Dominican order who were, on the view of its founders, abusing the historical method to undermine the true sense of Aquinas's thought.1 The founders singled out Étienne Gilson (1884–1978), whose Le Thomisme, introduction au système de saint Thomas [End Page 1053] was published a couple of years earlier (in 1919); according to Mandonnet, Gilson's volume distorted the very nature and pedagogy of Thomist philosophy.2 Mandonnet and Gilson would become principal antagonists in the famous debates about Aquinas's thought in the 1920s and 1930s. Less known, however, are their parallel skirmishes in the field of Dante studies. In this article, I suggest that we need to consider the battles in Thomism and Dante studies together, as part of a wider intellectual war that would question the very nature of Catholic theology and philosophy. I first survey the main battlefield—the debates about Aquinas's thought—with specific reference to the controversies in the 1920s and 1930s about Gilson's "Christian philosophy" and about Marie-Dominique Chenu (1895—1990)'s Une école de théologie. In the second part, I turn to the skirmishes in the field of Dante studies between scholars such as, on the one hand, the French Dominicans Mandonnet and Joachim Berthier (1848—1924), who presented Dante as an essentially Thomist and Catholic poet, and, on the other hand, the lay historians Gilson and Bruno Nardi (1884—1968), who deconstructed the "myth of the Thomist Dante" and saw a fundamental disharmony between Aquinas's and Dante's thought, a view which profoundly influenced post-war Dante scholarship to the present day. In light of this intellectual history, in the third part, I reappraise constructively eight alleged points of divergence between Aquinas's and Dante's thought. In moral and political philosophy, collective obligations are promising “gap-stoppers” when we find that we need to assert some obligation, but can not plausibly ascribe this obligation to individual agents. Most notably, Bill Wringe and Jesse Tomalty discuss whether the obligations that correspond to socio-economic human rights are held by states or even by humankind at large. The present paper aims to provide a missing piece for these discussions, namely an account of the conditions under which obligations can apply to (...) loose collections of agents that do not qualify as collective agents in their own right. I first explain the notion of joint obligations of loose collections of agents as opposed to collective obligations of collections of agents that are collective agents in their own right, and argue that the conditions under which agents can jointly have obligations are the conditions under which they are jointly able to do what is required. I then build on Virginia Held’s seminal work on the moral responsibility of “random collections” to develop such conditions for joint ability. My discussion shows that collections of individuals can more easily be subject to moral obligations than previously assumed. It also shows that putative joint obligations need to be carefully time-indexed, and that it is largely an empirical question whether a given collection can be subject to a moral obligation to perform a given joint action at a particular time. When several agents together produce suboptimal outcomes, yet no individual could have made a difference for the better, Act Consequentialism counterintuitively judges that all involved agents act rightly. I address this problem by supplementing Act Consequentialism with a requirement of modal robustness: Agents not only ought to produce best consequences in the actual world, but they also ought to be such that they would act optimally in certain counterfactual scenarios. I interpret this Modally Robust Act Consequentialism as Act Consequentialism plus (...) a requirement of moral virtue, namely, to reliably act rightly and to act rightly for the right reasons. Since the outbreak of the war in the Ukraine, realism has made a comeback in public discourses but it is not clear what realism actually means as it seems to stand for everything: from supporting the Ukraine against Russian aggression to the war is the West’s fault. This is the result of decades of not distinguishing between neorealism and classical realism and implicitly acknowledging neorealist storytelling of having systematized classical realist thought. The present paper is a further intervention to carefully (...) distinguish between both theoretical perspectives to uncover what they can add to current world political problems. It finishes by asking if neorealist scholars like John Mearsheimer have a point that it is the West’s fault and a diplomatic solution needs to be found. The aim of this paper is to argue that lying differs from mere misleading in a way that can be morally relevant: liars commit themselves to something they believe to be false, while misleaders avoid such commitment, and this difference can make a moral difference. Even holding all else fixed, a lie can therefore be morally worse than a corresponding misleading utterance. But, we argue, there are also cases in which the difference in commitment makes lying morally better than misleading, (...) as well as cases in which the difference is not morally relevant. This view conflicts with the two main positions philosophers have defended in the ethics of lying and misleading, which entail either that lying is in virtue of its nature worse than misleading or that there is no morally relevant difference between lying and misleading. Relying on aesthetic testimony seems problematic. For instance, it seems problematic for me to simply believe or assert that The Velvet Underground's debut album The Velvet Underground and Nico (1964) is amazing solely because you have told me so, even though I know you to be an honest and competent music critic. But why? After all, there do not seem to be similar reservations regarding testimony from many other domains. In this paper, I will argue that relying on aesthetic testimony (...) seems problematic because we are attached to an ideal of aesthetic authenticity and feel that living up to this ideal is anathema to simply relying on aesthetic testimony. Computational models have shown how polarisation can rise among deliberating agents as they approximate epistemic rationality. This paper provides further support for the thesis that polarisation can rise under condition of epistemic rationality, but it does not depend on limitations that extant models rely on, such as memory restrictions or biased evaluation of other agents’ testimony. Instead, deliberation is modelled through agents’ purposeful introduction of arguments and their rational reactions to introductions of others. This process induces polarisation dynamics on its (...) own. A second result is that the effect size of polarisation dynamics correlates with particular types of argumentative behaviour. Polarisation effects can be soothed when agents take into account the opinions of others as premises, and they are amplified as agents fortify their own beliefs. These results underpin the relevance of argumentation as a factor in social-epistemic processes and indicate that rising issue polarisation is not a reliable indicator of epistemic shortcomings. In Part III of his Remarks on the Foundations of Mathematics Wittgenstein deals with what he calls the surveyability of proofs. By this he means that mathematical proofs can be reproduced with certainty and in the manner in which we reproduce pictures. There are remarkable similarities between Wittgenstein's view of proofs and Hilbert's, but Wittgenstein, unlike Hilbert, uses his view mainly in critical intent. He tries to undermine foundational systems in mathematics, like logicist or set theoretic ones, by stressing the (...) unsurveyability of the proof-patterns occurring in them. Wittgenstein presents two main arguments against foundational endeavours of this sort. First, he shows that there are problems with the criteria of identity for the unsurveyable proof-patterns, and second, he points out that by making these patterns surveyable, we rely on concepts and procedures which go beyond the foundational frameworks. When we take these concepts and procedures seriously, mathematics does not appear as a uniform system, but as a mixture of different techniques. (shrink)

The Machinic Unconscious, Félix Guattari lays the groundwork for a general pragmatics capable of resisting the semiotic enslavement of subjectivity. Concluding that psychoanalytic theory had become part and parcel of a repressive, capitalist social order, Guattari here outlines a schizoanalytic theory to undo its capitalist structure and set the discipline back on its feet. Combining theoretical research from fields as diverse as cybernetics, semiotics, ethnology, and ethology, Guattari reintroduces into psychoanalysis a “polemical” dimension, at once transhuman, transsexual, and transcosmic, that brings out the social and political—the “machinic”—potential of the unconscious. To illustrate his theory, Guattari turns to literature and analyzes the various modes of subjectivization and semiotization at work in Proust's In Search of Lost Time, examining the novel as if he were undertaking a scientific exploration in the style of Freud or Newton. Casting Proust's figures as abstract mental objects, Guattari maps the separation between literature and science, elaborating along the way such major Deleuze-Guattarian concepts as “faciality” and “refrain,” which would be unpacked in their subsequent A Thousand Plateaus: Capitalism and Schizophrenia. Never before available in English, The Machinic Unconscious has for too long been the missing chapter from Deleuze and Guattari's Anti-Oedipus project: the most important political extension of May 1968 and one of the most important philosophical contributions of the twentieth century. Interactions between the host and its associated microbiota differ spatially and the local cross talk determines organ function and physiology. Animals and their organs are not uniform but contain several functional and cellular compartments and gradients. In the intestinal tract, different parts of the gut carry out different functions, tissue structure varies accordingly, epithelial cells are differentially distributed and gradients exist for several physicochemical parameters such as nutrients, pH, or oxygen. Consequently, the microbiota composition also differs along the length of (...) the gut, but also between lumen and mucosa of the same intestinal segment, and even along the crypt‐villus axis in the epithelium. Thus, host‐microbiota interactions are highly site‐specific and the local cross talk determines intestinal function and physiology. Here we review recent advances in our understanding of site‐specific host‐microbiota interactions and discuss their functional relevance for host physiology. (shrink)

In his novel, Truong indeed invites us to think over the contextuality of the body and the human identity by substituting an anthropocentric and dualistic point of view with an ontology of emergence. Who should be recognized as a refugee? This article seeks to uncover the normative arguments at the core of legal and philosophical conceptions of refugeehood. It identifies three analytically dist...

What is political about political refugeehood? Theorists have assumed that refugees are special because their specific predicament as those who are persecuted sets them aside from other “necessitous strangers.” Persecution is a special form of wrongful harm that marks the repudiation of a person's political membership and that cannot—contrary to certain other harms—be remedied where they are. It makes asylum necessary as a specific remedial institution. In this article, I argue that this is correct. Yet, the connection between political membership, (...) its repudiation, and persecution is far from clear. Drawing on normative political thought and research on autocracies, repression, and migration studies, I show that it is political oppression that marks the repudiation of political membership and leads to various forms of repression that can equally not be remedied at home. A truly political account moves away from persecution and endorses political oppression as the normative pillar of refugeehood and asylum. (shrink)

Notes and journal entries document Guattari and Deleuze's collaboration on their 1972 book Anti-Oedipus. "The unconscious is not a theatre, but a factory," wrote Gilles Deleuze and Félix Guattari in Anti-Oedipus, instigating one of the most daring intellectual adventures of the last half-century. Together, the well-known philosopher and the activist-psychiatrist were updating both psychoanalysis and Marxism in light of a more radical and "constructivist" vision of capitalism: "Capitalism is the exterior limit of all societies because it has no exterior (...) limit itself. It works well as long as it keeps breaking down."Few people at the time believed, as they wrote in the often-quoted opening sentence of Rhizome, that "the two of us wrote Anti-Oedipus together." They added, "Since each of us was several, that became quite a crowd." These notes, addressed to Deleuze by Guattari in preparation for Anti-Oedipus, and annotated by Deleuze, substantiate their claim, finally bringing out the factory behind the theatre. They reveal Guattari as an inventive, highly analytical, mathematically-minded "conceptor," arguably one of the most prolific and enigmatic figures in philosophy and sociopolitical theory today. The Anti-Oedipus Papers are supplemented by substantial journal entries in which Guattari describes his turbulent relationship with his analyst and teacher Jacques Lacan, his apprehensions about the publication of Anti-Oedipus and accounts of his personal and professional life as a private analyst and codirector with Jean Oury of the experimental clinic Laborde. Many philosophers, following Williamson (The Philosophical Review 105(4): 489–523, 1996), Williamson (Knowledge and its Limits, Oxford, Oxford Univer- sity Press, 2000), subscribe to the constitutive rule account of assertion (CRAA). They hold that the activity of asserting is constituted by a single constitutive rule of assertion. However, in recent work, Maitra (in: Brown & Cappelen (ed). Assertion: new philosophical essays, Oxford, Oxford University Press, 2011), Johnson (Acta Analytica 33(1): 51–67, 2018), and Kelp and Simion (Synthese 197(1): 125–137, 2020a), Kelp and (...) Simion (in: Goldberg (ed) The Oxford Handbook of Assertion, Oxford, Oxford University Press, 2020b) aim to show that, for all the most popular versions of the constitutive rule of assertion proposed in the literature, asserting is not an activity constituted by a single constitutive rule and that therefore CRAA is very likely false. To reach this conclusion, they all present a version of what can be dubbed the engagement condition objection. That is, they each propose a necessary condition on engaging in rule-constituted activities. Then they argue that, for all the most popular versions of the constitutive rule of assertion proposed in the literature, one can make assertions without satisfying this condition. In response, I present a counterexample that shows that the proposed engagement conditions lead to coun- terintuitive results, and I propose an alternative that better captures our intuitions. Then I argue that this alternative engagement condition is compatible with all the most popular versions of the constitutive rule of assertion. (shrink)

This study synthesizes research on evolutionary psychology, emotional appeals, and viral advertising in order to develop a novel perspective on how sustainable luxury brands can be effectively promoted on social media. The results of two experiments show that the emotional appeals of pride and gratitude increase consumer intentions to spread electronic word-of-mouth about sustainable luxury brands via two discrete mechanisms. Study 1 establishes that featuring the pride appeal increases eWOM intentions by heightening the luxury dimension of sustainable luxury brands, whereas (...) featuring the gratitude appeal increases eWOM intentions by heightening the sustainability dimension of sustainable luxury brands. Study 2 shows that these discrete effects of emotional appeals influence consumers to adopt different types of eWOM behaviors toward sustainable luxury brands. Specifically, the pride appeal increases consumer intentions to broadcast eWOM via status attainment motives. In contrast, the gratitude appeal increases consumer intentions to narrowcast eWOM via affiliation seeking motives. The findings offer novel theoretical insights and provide managers with tools to promote sustainable luxury brands in a digital environment. (shrink)

Es geht im Kern darum, diese Prinzipien und Mechanismen zu verstehen, Handlungsformen und Institutionen mit Blick auf gesellschaftliche Probleme und deren Behebung zu entwickeln und auf diesem Wege Gesellschaft menschlicher, gerechter und demokratischer zu gestalten. Aus diesem Grund scheint der Pragmatismus für die kritische zeitgenössische Sozialwissenschaft von größter Bedeutung. Who should be recognized as a refugee? This article seeks to uncover the normative arguments at the core of legal and philosophical conceptions of refugeehood. It identifies three analytically distinct approaches grounding the right to refugee status and argues that all three are normatively inadequate. Refugee status should neither be grounded in individual persecution for specific reasons (classical approach) nor in individual persecution for any discriminatory reasons (human rights approach). It should also not be based solely on harm (humanitarian approach). (...) Rather, this article argues, it should be based on political oppression – on persons lacking public autonomy, formally expressed as a lack of legal–political status. The normative foundation for a claim to refugee status lies in the inability of a person to control, amend and seek recourse to the specific situation she faces. It lies in the lack of public autonomy expressed as a lack of legal–political rights. What matters for a claim to refugee status is thus the legal–political disenfranchisement of a person, ultimately leaving her with no recourse to the particular situation she faces other than flight. Refugees, then, are not only those who fear harm or persecution, but those who are politically oppressed. (shrink)

Should refugees govern refugee camps? This paper argues that they should. It draws on normative political thought in consulting the all-subjected principle and an instrumental defense of democratic rule. The former holds that all those subjected to rule in a political unit should have a say in such rule. Through analyzing the conditions that pertain in refugee camps, the paper demonstrates that the all-subjected principle applies there, too. Refugee camps have developed as near distinct entities from their host states. They (...) have formed their own economic, legal and even political systems within which refugees are subjected to political rule. The paper then demonstrates that democratic rule should be preferred over any other decision-making procedure. No amount of experts can replace the institutions that would lead to the accountability of decision-makers and to the incorporation of refugees as situated and epistemically diverse knowers of the problems they face and the solutions that would work best.
